New documents have been posted on PACER in the last couple of days and Shamil has made them available to the rest of us. http://www.shamil.la/vbulletin-solutions-vs-xenforo-limited-etc/#97 The gist appears to be that IB is now asking for a list of all XenForo's clients so it can "depose" them and find out what dealings (communications, etc) there have been between them and why! That should be interesting - and not really in their best interests, I would imagine.
I've no idea how many of the XenForo customers are former vBulletin customers. But I cannot imagine IB having deep enough pockets to afford depositions from all of them. And I do say "them" rather than "us", as I suspect my 24 month hiatus with Invision will preclude any efforts to depose myself. What is really sad is I don't see any of this ending any time soon.
Carnac The Magnificent: "Well, *that* was not a good idea." Ed McMahon: "What will IB's management team say after their lawyers depose clients who have switched to XF and their comments are now on public record as part of the lawsuit?"
Kev, I think this is one of those, "be careful what you hope for" situations. Methinks IB is going to learn a lot of what they prefer to ignore, if they start asking too many questions. I'm still interested to see how IB managed to weave Mert into all of this. Considering Mert earns at least a portion of his crust from Crawlability, it seems any mercenary motives he might have would be to protect IB. I suspect it's all part of IB's "shotgun" approach.
Last time I paid for vBulletin was when I was 12 or 13 and it was a leased license, so I've been done with vB for around 5 or 6 years now .
My last two vB licences were given to me as part of the beta testing team. I moved from vB to IPB.. are they going to demand the customer list of IPB for those people who went there as well?
Ridiculous fishing expedition/narrative building exercise. Long-term it'll backfire, short-term it just prolongs the pain. Won't happen but they have to try as they're still operating on the narrative that the VB exodus isn't an event of their own doing (or lack of doing). You'll know they're running out of kitchen sinks to throw at this when you start seeing resignations/stock liquidations inside IB itself.
I've read through those documents, in fact I've read through all the documents filed. I don't normally comment on them because I'm not a expert in Californian law and regulations. I do however have some experience in UK civil law. I'm a little concerned about these latest filings. I don't know what jurisdiction California might have over a UK registered company but I do know that I don't want my xF details revealed to VBSI. A cursory glance at the latest documents reveals more smoke and mirrors. If xF have been contacting vB customer via a plundered list I have to ask, what happened to my email? How can anyone possibly cancel their vB licence to buy into xF. Perhaps VBSI have forgotten that the current vB licence scheme provides a licence to use vB4.x for life. There are no renewals, therefore there are no cancellations. Every filing brings more evidence of a spiteful vendetta against xF. Past and even current employees have been dragged in and it now looks like there's a move entwine the xF customer base. It's all quite hateful.
Interesting move, not one I would suggest but interesting none the less. I don't see IB gaining any fans over all this..lol I still have a vb 3.8 license that I can't sell and I'm told I'll have access to the support forums for life.. It helps with the freelance stuff I do but looking up bugs on updates is really all I do at vb.com anymore.
