In THIS thread, there was mention about it not being clear on how to issue a DMCA Takedown Notice. I was on the verge of writing an article and then found this one which I think does the job nicely. It covers everything from finding your stuff on the net, through who to contact and what to include in the DMCA and even has a sample DMCA notice at the end of the article. Hopefully there will never be any need for you to use one, but the information is now available if it does become necessary. Have you ever sent/received a DMCA? How did you handle it?
Yeah, that's very similar to what I use. And TheLaw.com is a great legal resource! The owner is really nice and informative.
I've never sent or received a DMCA notice but I have sued for copyright infringement in the dim and distant past. I did recently advise a forum member who was in receipt of a DMCA notice. He'd had a site built to support his business. The site designer had not only blatantly copied a rival company's site but his site was pulling images from his rival's site
Received a few in our time based on some of our member-posted content. We have a strong anti-plagiarism policy, but some people try to get things in the cracks anyway. We confirm the breach of IP and handle things in an expeditious manner. Plagiarism is one of the few offenses that's in the near-mortal-sin category and a strong indicator that somebody isn't going to work out long-term in our community.
Over the years I had a flurry of them on and off from various communites I was a part of. Mostly for things like having tools to get around DeCSS or tools for backing up video games. We were not the pirates, we just liked the tinker. All we did was retain our content and move the files off site. Problem solved. That was a long time ago though...I haven't had one in many years and never felt the need to send one out myself.
